Terms and Conditions

These General Terms and Conditions (T&Cs) govern all sales made by Achat d'Art via our website www.achatdart.fr. By placing an order, you accept these terms without reservation. Last updated: 16 November 2025.

1. Purpose

These T&Cs define the contractual relations between Achat d'Art and the buyer. They prevail over any other document from the buyer. Any order implies full acceptance of the T&Cs.

2. Products

The products offered are works of art (paintings, sculptures, etc.) described on the site. Visuals are indicative; minor variations may exist. The works are unique or in limited edition.

3. Orders

Orders are placed via the site. Confirmation by email. Achat d'Art reserves the right to refuse an order for legitimate reasons (out of stock, previous non-payment).

  • Minimum age: 18 years or emancipation.
  • Validation: Effective payment.

4. Prices

Prices are in euros including VAT, including French VAT. Shipping costs additional, displayed before validation. Achat d'Art reserves the right to modify prices without notice, but validated orders are at fixed price.

5. Payment

Secure payment by credit card (via PCI DSS certified provider), PayPal or bank transfer. No order will be processed without full payment. In case of delay, penalties of 1.5% per month.

6. Delivery

Delivery to mainland France and EU via Colissimo or specialised carrier (fragile works). Times: 3-7 working days. Costs: Calculated based on weight/volume. Risk transferred to the buyer upon delivery.

  • Insurance: Included for declared value.
  • Delay: No liability beyond 30 days.

7. Right of Withdrawal

In accordance with Article L221-18 of the Consumer Code, you have 14 days to exercise your right of withdrawal without reason. Return at our expense if unopened; otherwise, deduction for wear.

Exceptions: Customised or perishable works.

8. Warranties

Legal warranty of conformity (2 years) and against hidden defects (2 years). The works are authenticated; certificates provided. Return under warranty: Full coverage.

9. Liability

Achat d'Art is only liable for direct damages. No liability for indirect losses. Force majeure exempts from liability.

10. Intellectual Property

The works remain the property of Achat d'Art until full payment. The buyer acquires a private use right; any commercial reproduction is prohibited.

11. Disputes

Any dispute is subject to French law. Jurisdiction of the courts of Nantes. Mediation possible via the European Commission's ODR platform.

12. Modifications

Achat d'Art reserves the right to modify the T&Cs. New versions apply to orders subsequent to their publication.
